In consideration of the mutual covenants set forth in this Agreement, Customer (“Renter”) and E-ChairLLC hereby agree as follows: 1. Rental Agreement and Rental Fees. Company agrees to rent the above named to the renter at a rate mentioned above. Renter agrees to pay all rental fees prior to taking possession of the equipment. 2. Definition of a Rental Period. For the purpose of this Agreement, a Rental Period shail be any 24 hour period from the time the Renter takes physical possession of the equipment. 3. Return of Rental Equipment. Renter agrees to return the equipment during normal business hours prior to the next billing date. Renter agrees that if the equipment is not returned prior to the next billing date that the Renter’s Credit Card will be charged for another Rental Period. 4. Responsibilities of the Renter. Renter agrees to be financially responsible for all theft or damage that may occur to the equipment. In the event of theft or damage, Renter will be responsible for the cost of repair or replacement of the equipment Failure to compensate E-ChairLLC for theft or damage to the equipment or failure to return the equipment in the same working condition as it left shall constitute a breach of Agreement. In the event of a breach of Agreement, Kerrville Medical Equipment has the right, but is not obligated, to pursue any or all of the following remedies: (1) termination of Agreement, (2) recovery of equipment, (3) bring legal action.
